WARNING
KITEFLYING IS DANGEROUS.
# Always use extreme caution when using this product.
# Misuse of this product can cause serious injury or death.
# Only use this product if you are in good physical health.
# Never act in a careless manner when using this product.
# You are responsible for your own safety and the safety of others around you when using this product.

What do you think of these stupid waivers (like the above) ?
It's written on my kite canopy in fine print.
Do you believe they are there for your benefit ?
or
Do you believe they are there to legally protect the manufacturer ?
It's interesting to note that no mention of professional instruction for newbies with the use of the product is included in the text.

I don't think much of them, they're a legal thing.
The best one I saw was on a dirt surfer.. it said something like..
"Do Not use this product unless at some stage you want to be injured and hurt"

ok now im no law buff but, is that actually gonna hold up in court? because there is no consideration givin by one of the sides (the buyer) so you could say that the contract is void due to a unilateral mistake? maybe the writing needs to say " in purchasing this product you have agreed to all of the following.........etc.) ????

Geez....They don't have to write anything !

At least they are making the effort to warn of the dangers.

I like those little notes !

I see them when I go to pump my kite,and they remind me to double check and be careful.

most of them say "not a toy" ect so people can't buy one, fly one, injure themselves and then claim they thought it was a kite and should have been told it was dangerous.
some of them are a bit stupid though

I agree it should not be held up in court, however they will not be liable for any damages possibly caused by their kite, like a jet ski once you take it over a jump(Wave) the warranty is void.
Mind you not trying to take the piss. if anyone had an accident on kite and tried to sue the manufacturer there either american or a red neck.(only some yanks not all)

What asshole takes their kite manufacture to court for their own stupidy, thats the real question. Our legal system is one that punishes the honest and rewards the stupid. If the manufacturer breaches duty of care they are liable. Their duty of care is to warn you of the inherent dangers. As said by slave they missed the part about seeking professional instruction before use, which is a breach in the duty of care (although still a grey area). Disclaimers dont hold up in court, however they do help, however in a legal situation the retard injuree could possibly pull the "failed to mention professional instruction" card.

I reckon my manual and kite says something like 'Bla Bla Bla, you will die, others will die, serious injury, death, destruction, Bla Bla Bla.....If you pump up this product then you aggree to these terms and conditions, if you dont then return the product to the manufacturer.

Its always good value to have a read first, then you will be grinning even more when you pump up your new baby

I saw this on a child's ride at Australian Wonderland.

There should be an advertising campaign like whats happening with smoking.

Kitesurfing caused depression - if its not windy.

Kitesurfing causes A.D.D and productivity dysfunction at work - If its windy. You just stare as seabreeze pressing refresh over and over again....

Kitesurfing makes wind widows yell at you when you get home late.

Kitesurfing turns you into an alcoholic - when you go to the pub because you don't want to gold home to a angry wind widow.

Kitesurfing will make all you other sports seem lame, and you will give them up, then when its winter and there is no wind for 3 months you will get fat. Your wind widow will leave you for a another man who shows up for mothers day even if its windy.

So who wants to donate $$$ for TV time?
