so my question is this,
A mate got back from Brazil with hours of wavesailing footage. i am wanting to make some video clips to upload. whats the go with the music overdubbing, because i am not selling the vids can i use any music i like and not worry about royaltes etc?

Hey Gestalt,
As far as licensing goes unless you composed and played the music yourself or the music is more than 50 years old you will need to get permission from the original composer or copyright owner.
For pretty much all commercial music this means paying big bucks.
You can choose to ignore this and use the music anyway. Given that only a small number of people will actually look at your small little windsurf video the risk of litigation is probably small.
However, if the big record companies in the US decide to take YouTube to court I think YouTube will try to deflect blame onto users. This has happened with other companies like Napster in the past. Since it clearly states in YouTubes license agreements (which every uploader signed) that you must be the copyright holder of all works the stone will sit with you in the end.
If you are promoting any products in your video you will also expose the company promoted.
My personal opinion is split on this subject. On one hand I believe this could be a great promotional platform for unknown bands. On the other hand I wouldn't really like it if my music would suddenly pop up promoting something I don't morally believe in... my 5 cents.

Any unknown local band would love to hear their stuff on a surfing/sailing dvd, or youtube clip. Its probably the most fame they will ever experience.
Next time you're at the pub and there's a band playing, grab a copy of their demo tape.

My experience with these types of websites is that any form of complaint - eg. Dear YouTube. Please remove file because of copyright infringement or I will take legal action against you results in YouTube / Rapidshare type websites pulling the material off straight away and generally that will be the end of the issue unless you continue to upload copyrighted material and the complainent has more reason to complain, in which case you will generally be banned from uploading well before any legal action is ever taken. It seems the only time legal action is taken straight away is if chinannigans have been going on for a while (eg. software/video piracy and all the obvious antipiracy adds) and people have been well and truly warned beyond any doubt. One person making a non-income home vid using copyrighted music would hardly turn an eye, considering how much of it goes on already.
Not that i personally have ever done anything like this ...honest

Kurt Cobain told me before he died that I could use one of his songs for a small video clip if I wanted. So its ok everyone, stop stressing.
